1. GENERAL

1. By using, browsing or accessing (“Use”) any part of the portal known as Carlisle Home Care you agree to be bound by these terms and conditions.
2. Carlisle Homes Pty Ltd (“Carlisle Homes”) reserves its right to at any time:
• limit or terminate your ability to Use Carlisle Home Care; and
• review your Use of Carlisle Home Care to ensure such Use complies with these terms and conditions.
3. By your Use of Carlisle Home Care you acknowledge Carlisle Homes’ right to vary these terms and conditions at any time without notice. By continuing to Use Carlisle Home Care you agree to be bound by the current terms and conditions howsoever updated.

2. LOGIN AND PASSWORD DETAILS

1. You must keep your user ID and password (“Account Details”) secure at all times. You must not disclose, permit to be disclosed or share with others your Account Details.
2. You must maintain the confidentiality of your Account Details at all times. You are fully responsible for all acts and omissions of any person or organisation that has accessed Carlisle Home Care with your Account Details as if they were your own acts and omissions.
3. You agree that Carlisle Homes will not in any event be liable for any loss, damage, claims, costs or expenses arising out of the use or misuse of your Account Details. You agree to indemnify Carlisle Homes against all loss, damage, claims, costs or demands in this regard.
4. Unauthorised use or misuse of your Account Details may lead to revocation of your Use of Carlisle Home Care.
5. You must immediately notify Carlisle Homes if you become aware or reasonably believe that your Account Details have been compromised or are known by a third party or there has been unauthorised use of your Account Details.

3. USER INFORMATION

1. You warrant that all information, photographs, material and any data provided in connection with your Use of Carlisle Home Care (“User Information”) is complete, current, and accurate, is not misleading and does not misrepresent your identity or your property.
2. You agree that Carlisle Homes may rely on your User Information unless and until it receives written notification from you of any change or update to the User Information provided. Any varied User Information will be covered by the warranty provided by you.
3. If your User Information involves or contains images or references to a person(s) you warrant that the person(s) is aware and has consented to the use of that image or reference.
4. You agree that your User Information may be used by Carlisle Homes to assist us in providing you with our products and services, to assist with communications you make with us and for internal administrative purposes. We may provide your User Information to suppliers and subcontractors as required for the carrying out of inspections and building works. We may also use your User Information entered by you to communicate news, promotional offers or special events or we may use the information for marketing, research, planning, product development and issue resolution.

4. ACCESS

1. The accessibility and operation of Carlisle Home Care relies on internet technologies outside of Carlisle Homes’ control. Carlisle Homes does not guarantee continuous accessibility or uninterrupted operation of Carlisle Home Care.
2. Carlisle Homes will not be liable for any loss, damage, cost or expense resulting from any delay in operation or transmission, communications failure, internet access difficulties and malfunctions in equipment or software.
3. You acknowledge and agree that Carlisle Homes’ employees and contractors are permitted to access and use Carlisle Home Care and all User Information you provide.

5. SECURITY

1. Carlisle Homes is not liable for the security, authenticity, integrity or confidentiality of any transactions and other communications made through Carlisle Home Care.
2. Internet communications may be susceptible to interference or interception by third parties. Despite its best efforts, Carlisle Homes makes no guarantees that Carlisle Home Care is free of infection by computer viruses or other unauthorised software. Carlisle Homes will not be liable for any loss, damage, cost or expense resulting from any breach of a security measure (including viruses or other unauthorised software).

6. ACCURACY OF INFORMATION

1. Carlisle Homes has taken all reasonable measures to ensure the quality, reliability, and accuracy of the information on Carlisle Home Care. However, Carlisle Homes:
   • reserves the right to delete, add to or amend information on Carlisle Home Care without notice;
   • is not responsible for the accuracy or reliability of the content of third party suppliers of goods or services and other websites linked to or referenced from Carlisle Home Care; and
   • makes no warranties or representations, expressed or implied, as to the accuracy of information contained within Carlisle Home Care.
2. Pictures contained in Carlisle Home Care provided by Carlisle Homes are for illustrative purposes only and may depict upgrade options available at additional charges such as lighting, window furnishings & timber windows. Pricing also excludes features not supplied by Carlisle, inc fencing, landscaping, letterbox, decking and driveway.

7. COPYRIGHT

1. Carlisle Home Care and its contents are subject to intellectual property and copyright owned by Carlisle Homes or a third party and you may not reproduce, adapt, modify, communicate to the public, or otherwise use in whole or in part any aspect of Carlisle Home Care without Carlisle Homes’ prior written permission.
2. By your Use of Carlisle Home Care you agree to grant Carlisle Homes and all related entities a perpetual, non-exclusive, royalty free, irrevocable, transferable and world-wide licence (including the right to sub-licence) to use, copy, adapt, communicate, reproduce, display, exploit, publish, re-distribute, broadcast and incorporate in other works, at any time and for any purpose while you Use Carlisle Home Care.
3. You warrant that all information entered into Carlisle Home Care by you does not breach the copyright howsoever of any third party. You agree to indemnify Carlisle Homes against all loss, damage, claims, costs or demands in this regard.

2. You acknowledge and agree that Carlisle Homes may use any User Information, including but not limited to your personal information, you provide to Carlisle Home Care for any purpose whatsoever, including marketing purposes, product development and issue resolution.

9. INDEMNITY AND LIMITATION OF LIABILITY

1. You agree to indemnify Carlisle Homes against any loss or damage to any person arising from any one of the following:
• Any breach by you of these terms and conditions; and/or
• Any act or omission by you in relation to, or in the course of Use of Carlisle Home Care.
2. Carlisle Homes will not be liable for any loss, damage, cost or expense of any kind resulting from:
• the Use or inability to Use Carlisle Home Care;
• unauthorised access or alterations of your transmissions to or from Carlisle Home Care;
• activities resulting from the loss or misuse of your Account Details or other access mechanism;
• statements or conduct of any third party; and/or
• any other matter relating to Carlisle Homes Care.

1. Use of Carlisle Home Care and these terms and conditions are governed by the laws of the State of Victoria.
